Terms and Conditions of Sale

The following terms and conditions of sale apply to all purchases made by you through the website under the domain names www.occasianz.com & www.occasianz.co.uk  (the “website”).

By offering to purchase products through the website you are entering into an agreement with OccAsianZ Ltd Registered in England no. 05027604 whose Registered office is at 5 Jupiter House, Calleva Park, Aldermaston, Berkshire, RG7 8NN on the terms and conditions set out below.

Purchase of Products from the Shop

Specifications on the website of the products to be supplied by OccAsianZ Ltd are not intended to be binding and are intended only to give a general description of the products.

OccAsianZ Ltd reserves the right to make any changes in the specification necessary to comply with any applicable legal requirements and to change the specification published on the website provided that this does not materially affect the quality or performance of the products.

OccAsianZ Ltd warrants that it has the right to supply all products offered by it on the website and that the products will substantially comply with their description.
In all other respects, and to the maximum extent permissible, OccAsianZ Ltd makes no other warranties or promises about the products, and any implied warranties are excluded.

Availability, Prices and Information of Products

OccAsianZ Ltd does not promise that products are necessarily available, and all products are offered for sale subject to availability. The price of the products shall be the price listed on the website on the date of your order (inclusive of VAT but exclusive of delivery charges which are payable by you). All prices displayed on the website are quoted in £GPB pounds sterling and must be paid in full, including delivery charges, except where discounts are offered as detailed on the website.
 
We accept all major credit and debit cards and payments by PayPal. OccAsianZ Ltd cannot accept payment by cash, cheque or postal order for orders placed on the online shop unless otherwise agrreed in writing by OccAsianZ Ltd.

In the event that we are unable to fulfil your order, we will contact you and where possible, suggest a closely matching alternative. You can then choose whether or not to accept the substitute items.

Ordering

When you click on the “Submit Order” on the “Review Order” page OccAsianZ Ltd will treat the order as an offer by you to purchase the products subject to these terms and conditions of sale. You are responsible for ensuring the accuracy of your order and if OccAsianZ Ltd accepts your offer they shall supply you, subject to availability, with the quantity and specification of products set out in your order.

If OccAsianZ Ltd accepts your offer they shall confirm each order online via the internet or by email and such confirmation shall be OccAsianZ Ltd acceptance of the contract between the parties. The goods are only confirmed as shipped when you receive a "completed" email from OccAsianZ Ltd meaning your order has been dispatched.

Delivery

OccAsianZ Ltd are unable to deliver outside of the UK, as the high cost of delivery beyond the UK currently makes such a service uneconomic. Please note that we cannot deliver to PO Boxes.

All products will be delivered to the address that you indicate on the “Checkout”  page and risk of damage to or loss of the products shall pass to you at the time of delivery even if the products have not been received by you in person.

Any times quoted for delivery are for guidance only and time shall not be of the essence. Orders are generally dispatched either by Royal Mail or by Courier dependent on the order's weight. All deliveries will require a signature at receipt. A processing, postage and packaging charge is payable on all orders according to the size of the order. This charge will be calculated at the checkout stage of your order. Royal Mail items are normally delivered in 3-4 days after you receive a "completed" email from OccAsianZ Ltd but cannot be considered lost until 15 working days have elapsed.

All shipments are governed by the Terms & Conditions of the relevant carrier; OccAsianZ Ltd shall not be liable for any delay in delivery of the products howsoever caused.

OccAsianZ Ltd will try and ensure that you receive your order, as quickly as possible, or if you wish you may cancel your order and we will refund you any money which you have paid.

Occasionally your order will be sent in multiple dispatches, this may be due to stock levels, difficult to package items.

You can check the status of you order at anytime after checkout by loging into your user account.

Cancellation and Returns

OccAsianZ Ltd wants you to be totally satisfied with your order. Every item we sell is carefully inspected before it is shipped if you would like to cancel your order and return the products you must inform us using our Online Returns Form within 7 working days after receipt of the order, we will arrange to collect them (the whole order) and give a full refund*.

All items must be received back in the original condition as supplied with all seals/shrink wrap intact.

OccAsianZ Ltd will confirm any cancellation by email and will repay to you the full cost of the order (including the cost of products and delivery*) within 30 days after receipt of your cancellation.

We will not refund the costs of return postage to us unless the products are faulty.

You may not cancel your order if it is for:

1. Products that are made to your specifications or clearly personalised, such as wedding cards, invitations, prints on demand;
2. Products that cannot be returned or are liable to deteriorate or expire rapidly;
3. Magazines,  newspapers, periodicals or the supply thereof
4. The supply of DVDs, CDs, software or other recordings in any format or computer software, that have been provided in a sealed package and that have been unsealed by you;
5. Unsealed/used items are not resalable, and therefore, not accepted for refunds if returned

*Where goods are supplied and include delivery free of charge, that are later returned for credit or refund, we reserve the right to deduct our costs from the refund total.

Security and Privacy

When you place your online order with OccAsianZ Ltd you are automatically connected to our secure server using 128 bit SSL encryption technology. This ensures that the information you send cannot be read by anyone apart from our e-commerce team. To check you are in a secure area of our website please look at the bottom of your browser and you will see a closed padlock.

When you submit your order you are authorising OccAsianZ Ltd to use your personal details to fulfil your order (through our contractors). For further details, please see our privacy policy and the questions set out on the order form page regarding the use of your personal details. In the event of there being a problem with your order we will communicate with you via e-mail, telephone or letter.

Registration and Passwords

If you register to create an account or to access any part of this site, you agree:

• To keep your password secure and confidential and not to allow another person to use your details or password to access your account or any part of this website.
• To notify OccAsianZ Ltd immediately if you become aware of any improper or unauthorised use of this website, or your details, or your password,
• Not to do anything which would assist any person who is not a registered user from gaining access to any password-protected area of this website.
• Not to create additional accounts for the purpose of abusing any person or the functionality of this website,
• Not to use another user’s account or details, and not to seek to pass yourself off as another user, and
• That you are solely responsible for all activity that takes place on your personal pages and your account.

Limitation of Liability

OccAsianZ Ltd liability to you is limited to refunding the price of the products only. OccAsianZ Ltd is not responsible to you to any greater extent and in particular is not liable to you for any indirect or consequential loss (including without limitation financial loss such as loss of profit or otherwise) that you may incur as a consequence of its failure to comply with these terms and conditions of sale.

For the avoidance of doubt nothing in these terms and conditions of sale shall serve to exclude or limit OccAsianZ Ltd liability in respect of death or personal injury caused by OccAsianZ Ltd negligence or the negligence of its officers or employees.

Changes to the Terms and Conditions of Sale

We advise you to print and keep a copy of these terms and conditions for your records. Please note that we may make changes to these terms and conditions from time to time, so please check them each time you use the online shop. If you continue to use the website after a change has been made you are deemed to have accepted these changes to the terms and conditions of sale.

Law and Jurisdiction

These terms and conditions of sale shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising in relation to the website shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If any of these terms or conditions of sale should be determined to be illegal, invalid or otherwise unenforceable, it shall be deemed deleted and the remaining terms and conditions shall survive and continue to be binding and enforceable.

Customer Feedback & Complaints

As OccAsianZ Ltd continues to grow, we welcome any feedback supplied by our customers to help improve our product offering and customer service levels.

If you have experienced any problems with any part of our service, please notify us with the facts to admin@occasianz.com and allow up to 14 days for a investigation to be carried out. It will be dealt with confidentially, and effectively.

Any publication of fallacious material will result in legal action for libel against the publisher.
